1. Obligations of the contract holder and authorised drivers in relation to the rented vehicle:

The contract holder is directly and jointly responsible for ensuring that the main driver or authorised additional drivers comply with the contractual obligations stipulated below while driving the rented vehicle.

If Record go considers that any of the following obligations have been violated, it reserves the right to take the relevant legal action, such as taking back the rented vehicle from the driver of the vehicle and/or legally requiring the return of the rented vehicle.

1.1. Obligations of the contract holder and authorised drivers at the time of pickup:

  • The rental invoice will be made in the name of the rental agreement holder and, once the contract has been issued, it will not be possible to modify it. To request an invoice in the name of a company, the client must communicate this fact before entering into the rental agreement.

  • To inspect the vehicle before leaving the parking space and to inform Record go of any discrepancies in relation to the vehicle’s condition described in the section of the contract "Annexe of damage information and verification". A discrepancy in the list of accessories present in the vehicle and damages that are not indicated or indicated incorrectly in the previously signed rental agreement.

  • To sign the ‘Pickup’ section of the "Annexe of damage information and verification" of the agreement as proof of acceptance of the condition of the vehicle at the time of pickup.  Signing the rental agreement implies the customer's acceptance of the list of accessories present in the vehicle and of the description of the damages included in the section of the contract "Annexe of damage information and verification".  Any damage that is not indicated in the contract will be considered to be new damage and will be attributable to the contract holder. In the event of breakage, loss or misplacement of the additional accessory or equipment marked as present in the vehicle, the contract holder will be liable for the replacement cost.

  • Where appropriate, to be responsible for the assembly of child car seats or any other extras that require assembly. Under no circumstance will Record go assume any responsibility for the assembly of accessories in the rented vehicle. 

  • If you have purchased the Meet & Greet Off-Airport extra, you must bear in mind the provisions indicated in point 4.2.3. with regard to this extra.

1.2. Obligations of the contract holder and authorised drivers during the rental period:

To use the vehicle in compliance with the following terms and conditions of use:

  • To notify Record go in the event of any technical failure in the rented vehicle: fluid levels (oil, water), tyre pressure, etc.

  • In the event of an accident, breakdown or engine failure, regardless of the coverage taken out, to follow the procedure established by Record go: 

    • Not to repair the vehicle without the prior consent of Record go.

    • Not to request a breakdown service without the prior consent of Record go.

    • Not to acknowledge or pre-judge responsibility for the incident.

    • Not to abandon the rented vehicle without taking the necessary measures to protect it and always stay with the vehicle until the towing service arrives.

    • To notify Record go within a maximum of 24 hours of any damage (with or without a third party) caused to the rented vehicle.
      Record go will assess the situation and determine the most effective solution: the driver will be recommended to drive to the airport to pick up a replacement vehicle, the vehicle will be repaired at the location of the incident, or, if it cannot be repaired, a tow truck will be sent to tow the rented vehicle back to the nearest Record go office and a replacement vehicle will be given to the contract holder.

    • Furthermore, only in case of damage, the driver must duly complete the accident or damage report, submit it to the Record go office upon returning the rented vehicle and send a copy of the report to the e-mail address [email protected]. The accident report must indicate the circumstances, place, date and time of the incident, as well as possible witnesses and the full contact details of any involved third parties.

    • If the duly completed accident report is not handed in, or in the event of negligence by the client, Record go reserves the right not to deliver a replacement vehicle. 

      In addition, the cover might become invalid. 

      Record go will process the accident reports, notify the driver of the appropriate action to take, and offer advice if they suffer any injuries and/or receive a court summons. Record go will charge the contract holder €50 for this accident management, damage control, and advice service (DAF). 
      If the contract holder has purchased our Total Comfort Cover, Record go will not charge any fee for this service.

  • In the event of theft or robbery of the rented vehicle, regardless of the coverage taken out, to follow the procedure established by Record go:

    • To immediately notify the relevant authorities and to file a police report and obtain the corresponding signed police report. If this document is not submitted to Record go, the coverage may be rendered void.

    • To notify Record go of the theft or robbery of the rented vehicle within a maximum of 24 hours.

    • To deliver the keys of the rented vehicle to Record go within a maximum of 24 hours. If the contract holder does not deliver the keys, he/she will be responsible for paying Record go the total excess amount of the vehicle. This clause shall only cease to apply if the police report indicates that the keys of the vehicle have been stolen.

  • Respect the road traffic regulations.  Respect the speed limits established for each vehicle type.

  • The client is responsible for the proper driving of the rented vehicle in accordance with Spanish law. Any damage to the rented vehicle as a result of driving the vehicle in the opposing lane will be considered as negligence. The contracted coverage will become invalid and the contract holder will be responsible for all the costs generated.

  • Possess sufficient knowledge for the proper driving of the rented vehicle. The client is responsible for the knowledge and proper driving of the rented vehicle, especially with regard to the operation of the gearbox. Any damage that may be caused to the vehicle as a result of an error in the gear shift, will be considered negligence, the contracted coverage will be invalidated and the contract holder will be responsible for all expenses generated.

  • In Mallorca, leave the on-street parking document visible on the front window. According to current regulations, it is forbidden to park vehicles for hire without a driver on public roads and in public areas that are determined when they do not have a valid rental contract. Vehicles for rental without a driver that are rented and parked must be visibly marked with the contract number, the duration of the contract, the start and end dates, the vehicle registration number and the name, address and telephone number of the rental company. In the event that the hirer parks on the public road and does not leave this document visible, Record go will not be liable for any penalty for this reason

• Record go shall not be held liable for costs incurred in repairing the following breakdowns or damage or any corresponding compensation: those brought about as a result of negligence or improper use by the drivers of the vehicles, failure to close the bonnet properly and those attributable to non-compliance with the instructions for use and maintenance set forth by the manufacturer in the instruction manual for each vehicle, in particular breakdowns that occur after continuing to drive when the oil pressure gauges, temperatures or brakes are showing sings of malfunction as well as not paying attention to the control panels, warning lights and alarms, having to change tyres due to acts of vandalism or negligence by the driver or any other person for whom he/she is responsible, breakdowns caused by uncleanliness in the vehicles when these are used in areas with mud, sludge or similar. Furthermore, RGO is not obliged to cover the costs of repairing the vehicles, nor of the corresponding compensation, in the following cases: damages that occur during the commission of intentional crimes, damages that occur while people who do not have the appropriate driving licence or who have violated a sentence that involves the withdrawal or suspension thereof is driving the vehicle, in an accident, if the driver of the vehicle causing the accident was convicted in an unappealable judgment for the crime of failure in duty to assist, damages caused inside port or airport premises and all those arising from breach of contractual obligations and those indicated in the following section regarding coverage.

1.3. Obligations of the contract holder and authorised drivers when returning the rented vehicle:

  • To return the rented vehicle with its keys, accessories and extras in the same working condition and cleanliness as they were delivered. If the contract holder returns the rented vehicle in a condition different to that specified by Record go at the time of pickup in the section of the contract “Annexe of damage information and verification”, the contract holder will be responsible for any alterations produced and for any missing documentation or accessories, and, depending on the type of coverage purchased (consult the types of coverage offered by Record go in section ‘4. Extras, accessories, charges and coverages’), may incur additional costs due to a violation of the contractual terms and conditions.

    • If the contract holder has purchased coverage with the provider of their bank account or with a third party, Record go will charge the corresponding amount up to the excess limit of the contract holder's bank card provided at the time of payment for the rental, and the contract holder will be responsible for claiming this amount from the provider of their bank card or from third parties. 

  • To ask Record go staff to inspect the state of the rented vehicle and to sign the "Drop-off" section of the "Annexe of damage information and verification" of the contract as proof of acceptance of the vehicle's condition upon return. If you do not ask RGO staff to check the vehicle when you return it, this will imply your consent for them to check it in your absence. 

  • To return the rented vehicle within office hours.

  • Only in Alicante, Barcelona Airport, Málaga, Madrid Airport, Madrid Atocha, Sevilla Santa Justa, Palma de Mallorca and Alicante train station. If the contract holder returns the vehicle outside of office hours, he/she must comply with the instructions of Record go for returning vehicles outside of office hours. 

    An out-of-office hours return is understood to be one that takes place outside the business hours indicated in point 10. In this case, it will not be necessary for the contract holder to make any arrangements with Record go staff. The keys of the vehicle must be deposited in the mailbox located in our offices in the car park.

    The contract holder will continue to be responsible for the rented vehicle until the rental office opens again. If the contract holder fails to comply with the instructions for returning the vehicle outside of office hours, he/she will continue to be responsible for the rented vehicle until Record go has access to the vehicle.

  • To return the vehicle to the agreed place, date and time. Record go offers a 60-minute grace period for returning the rented vehicle in relation to its pickup time. However, this grace period must be determined and applied at the moment of finalising the rental contract and selecting the vehicle return time.
     

    • If the rented vehicle is returned late, the coverage purchased will be rendered void and Record go will apply a penalty fee for each day of delay in returning the vehicle. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section '4. Extras, accessories, charges and coverages’). 

    • Record go does not offer one-way rentals. The contract holder must return the rented vehicle to the same office as the pickup.  If the contract holder returns the rented vehicle to an office other than where the vehicle was picked up, Record go will apply the corresponding penalty fee.

  • To inspect the vehicle before returning the keys and to make sure that no personal belongings have been left inside. Record go is not responsible for the loss of or damage to any personal belongings left inside the vehicle during or after the rental period. The contract holder is solely responsible for these items, which will be destroyed if they are not reclaimed by the lessee or authorised person within three months. If the lessee requests the return of their possessions via a courier service, they must pay the delivery charges and associated fees, if applicable.

  • If you have purchased the Meet & Greet Off-Airport extra, you must bear in mind the provisions indicated in point 4.2.3. with regard to this extra.

1.4. Additional obligations for the contract holder and authorised drivers whose non-compliance will invalidate the contracted cover

Failure to comply with any of the obligations described below will invalidate the contractual coverage, so that the contract holder will be liable to pay for the damage caused to the rented vehicle, the cost of the tow truck, the return of the vehicle, the additional cost of immobilisation of the rented vehicle until it is recovered, according to the table of fines in point 4.4 Fines, in addition to all other expenses incurred, up to the total excess amount.

The following cases of loss of cover and rights are expressly detailed and communicated to the customer during the booking process, highlighting the key information, so that the information can be selected for acceptance.       

  • Not to drive the vehicle while under the influence of alcohol, drugs, or any other substance that could affect the ability to drive. Record go accepts no responsibility for any accidents or damages to property caused by the rented vehicle if, at the time, the driver was driving under the influence of alcohol, drugs, or any other substance that could affect the ability to drive. The simple fact of driving under the influence of any of the aforementioned substances will be sufficient cause for the contract holder to be held responsible for the damages causes regardless of whether the influence of the aforementioned circumstances has been demonstrated in the damage charges.

  • For the rented vehicle to be driven exclusively by drivers expressly authorised by Record go in the rental agreement. 

  • Do not drive the vehicle outside of mainland Spain (with the exception of France, Portugal, Gibraltar and Andorra with prior authorisation by and payment to Record go – unavailable for two- and three-wheeled vehicles, in addition to vans), or between different islands, or between islands and the peninsula. In this respect, is not allowed to transport the rented vehicle on a ferry or any other type of maritime transport. If this obligation is breached, Record go will apply the corresponding penalty fee, the contracted coverage will be rendered void, and the contract holder will be responsible for all of the expenses generated, including the vehicle repatriation cost.

  • To fill the rented vehicle with the correct type of fuel, which is indicated in the "Vehicle information" section of the contract and also next to the fuel cap cover of the rented vehicle. Using the wrong fuel by mistake will constitute new damage and will be attributable to the contract holder.

  • Do not put water or red diesel into the fuel tank. The presence of water or red diesel in the tank shall be considered as negligence and the contract holder will be held responsible for it.

  • Do not leave the vehicle without fuel and/or AdBlue, or any other liquid that is required for the vehicle to function properly.  The vehicle will be delivered with a minimum level of AdBlue and if necessary, the client is responsible for refuelling.

  • (Electric vehicles) Not to run out of charge

  • Not to drive on unpaved, unauthorised or restricted roads. 

  • Not to drive with over the legal number of people for the type of rented vehicle. 

  • Not to use the vehicle as a form of public transport for people. 

  • Not to use the rented vehicle for illegal activities.

  • Not to use the rented vehicle to participate in races, competitions, or reliability or speed tests.

  • Not to use the vehicle for commercial purposes, as a courier service, or for the transportation of goods or people. In the case of vans (groups CKMR, NKMR, DKMR, IKMR, JKMR, SKMR and FKMR), rental shall be allowed provided that the customer procures the permits, licences and authorisations that may be necessary for the transport of goods, releasing Record go from any liability and assuming the obligation to compensate Record go for any damage that said non-compliance may cause.

  • Not to sublease the vehicle.

  • Not to use the vehicle to tow other vehicles.

  • Not to use the vehicle for the transportation of animals.

  • Not to use the vehicle for the transportation of explosives.

  • Not to use the vehicle for the transportation of corrosive substances.

  • Not to smoke inside the rented vehicle. If the vehicle smells of tobacco smoke, Record go will apply a penalty fee to cover the costs of processing, special cleaning, and vehicle suspension (See point 4.4 - penalties) . 

  • Not to park the rented vehicle in Record go parking spaces during the rental period. 

  • It is not permitted to disassemble or remove the seats in the hired vehicle.

  • Do not leave the lights turned on or let the battery run out. 

  • Provide an accident report in case of damage and hand it in at the Record go office when returning the rented vehicle and send a copy of the accident report to the e-mail address [email protected] within a maximum period of 24 hours after the incident. The accident report should state the circumstances, location, date and time of the incident, possible witnesses and full contact details of any third parties involved. 

  • If the vehicle is stolen, immediately inform the relevant authorities and file a police report, get the corresponding signed police report and return the vehicle keys or indicate in the report that the keys have been stolen.

Fit snow chains correctly, use them properly and do not leave them on for more time than necessary.

  • Park the vehicle without the handbrake or any other safety feature provided for this purpose.

4. Accessories, extras, coverage and penalty fees

4.1. Accessories

  • Car seats and children’s equipment.

    • Spanish and Portuguese legislations in force state that all children equal to or less than 135cm must wear a restraint device in the vehicle adapted to their height and weight.

    • The contract holder is solely responsible for installing the child car seat. Under no circumstances does Record go assume any responsibility for the assembly of child car seats in the rented vehicle.

    •  In the event of breakage, loss or misplacement, violent or non-violent theft of the child seat, the contract holder will be responsible for the additional payment of €200, as the replacement cost.

    • Equipment subject to availability. If not booked in advance, these may not be available upon the vehicle’s collection. 

    • Not available for two- and three-wheeled vehicles (scooters) or vans.

4.2. Extras

4.2.1. Extras related to the characteristics of the rented vehicle

  • Upgrade

  • The contract holder may purchase this extra at the desk to upgrade their vehicle.

    In the case of contracting the 'Upgrade' extra, if the contract holder has not taken out Total Comfort Cover, Record go will block the pre-authorization corresponding to the vehicle group that the holder has upgraded to and he/she will be responsible up to the excess amount corresponding to that vehicle group.

  • Car choice

  • The contract holder has the possibility of contracting this extra in order to choose a vehicle model from among the models available within the contracted category. Subject to availability.

  • Extra kilometre packs

  • If the contract holder purchases this extra, it will increase the daily mileage limit applicable to the FlexRent and FlexRent Pro rates.

4.2.3. Extras relating to pick-up and return of the vehicle

  • Meet & Greet Off-Airport.

  • This service offers the option for our staff to deliver the vehicle and sign the rental contract at the airport, saving you the bother of having to travel to our office.

    Requirements, conditions and price:

    • You can purchase this extra when placing your booking or at any time via telephone by calling our helpline; however, this must be purchased at least 24 hours in advance. Subject to availability according to rental office.

    • You will need to pay in advance, using any of our accepted payment methods.

    • You must provide your flight number. If you do not have this at the time of booking, you will need to add it as soon as you have access to this information. Without this, Record go cannot guarantee the correct provision of this service and may not be held liable.

    • You must provide an email address, to which we will send the location of the meeting point and a contact telephone number.

    • The pick-up must be made within our office hours.

    • If you want to make any changes with regard to the details provided in your booking, you must sign the contract in the Record go office.

    • We recommend setting your pick-up time at 30 minutes after your flight’s expected landing time.

    Vehicle pick-up:

    After the time provided for vehicle pick-up, you will have an additional courtesy margin of 30 minutes. If you do not arrive within this period, you will need to arrange your own transport to our office for pick-up, through your own means or via our shuttle. In this case, the cost of the Meet&Greet service will not be returned.

    In the case of early or late pick-up, you will have 60 minutes before your pick-up time to advise us, by calling the pick-ups office directly or by contacting our call centre. 

    If you notify us within less than 60 minutes of your pick-up time, a late- pick-up penalty of €20 will be applied for parking and staff costs. No penalty will be applied for early pick-up, although this may be denied according to availability and preparation.

    Vehicle drop-off:

    If you exceed the additional 30 minutes provided, you can still return the vehicle to the pick-up car park or to the drop-offs office indicated on the rental contract, although penalties will be applied for late return and an extra day’s rental, as provided in point 4.4. regarding penalties. In any case, you should advise the rental office and confirm your return time.

    If returning the vehicle to the car park outside of office hours, the abandoned vehicle penalty will be applied – in addition to the charges listed above – as provided in point 4.4. regarding penalties.

    Includes airport car park ticket until the specified pick-up time, with an extra 15 minutes after this time. If this extra time is exceeded, the additional parking costs will be borne by the customer.

  • Express Line

  • Free priority collection at certain rental rates.

  • Flight/train diversion: 

  • If the flight lands in an airport other than that indicated on the booking, the customer can pick up a vehicle from that airport, provided that Record go has an office at that site, and subject to vehicle availability.

4.2.4. Extras related to the territory in which the vehicle is driven

Cross-border

Only in Mallorca, Ibiza and Menorca:
If the contract holder and the authorised drivers wish to drive or embark between the islands of Mallorca, Menorca and Ibiza, they can do so if they contract the ‘Cross border’ extra. The ‘Cross border’ extra is rented for the whole rental period. It is not possible to rent it for single days. Under no circumstances will it be possible to take the vehicle to Formentera; significant sanctions may be imposed on the driver by the local authorities. It will not be possible to contract when any of the offices on these islands are closed, see for example Ibiza and Menorca in the low season. The opening hours can be consulted in point 10.

Not available for two- and three-wheeled vehicles (scooters) or vans.

All except Mallorca, Ibiza and Menorca:
Record go does not permit cross-border rentals. By exception, Record go can authorise driving in France, Portugal, Gibraltar and Andorra if the contract holder purchases the 'Cross border' extra. The ‘Cross border’ extra is rented for the whole rental period. It is not possible to rent it for single days.

Not available for two- and three-wheeled vehicles (scooters) or vans.
Price of the 'Cross-border' extra:

If the contract holder has not purchased Total Comfort coverage but has purchased the "Cross-border' extra, and has a breakdown or accident while abroad, the contract holder will be responsible for all of the expenses generated, including the vehicle repatriation fees to return the vehicle to the nearest Record go rental office.

 

4.3. Coverage

None of the following coverages include theft, loss or damage to the driver’s personal belongings.   

4.3.1. Basic coverage with excess

Basic coverage with excess is included in the rental price.

Only drivers expressly authorised by Record go in the rental agreement are covered by the basic coverage with excess. 

The coverage is only valid during the rental period. If the vehicle is returned late, the coverage is rendered void.

The basic coverage with excess includes the following aspects:

  • Coverage of collision damage and theft WITH excess (CDW and TP)

  • Partial exemption of responsibility for collision damages or theft, reducing the financial responsibility of the contract holder for damages or theft of the rented vehicle.

    If there is damage to the rented vehicle, the contract holder will be responsible for paying the damages generated up to the limit of the excess corresponding to the group of the rented vehicle, provided that the driver uses the vehicle in accordance with the terms and conditions of the rental agreement.

    If the contract holder/driver does not follow the procedure established by Record go in the event of causing damage to the vehicle or theft of the vehicle (see section 1.4) or violates any of the terms or conditions of the rental agreement, the basic coverage with excess will be rendered void, and the contract holder will be responsible for paying the total excess amount corresponding to the group of the rented vehicle.

An employee will check the vehicle with the lessee upon return and their claims will be taken into account. You will be sent a valuation report with detailed costs and how they were calculated, as well as justification for damages.In case of dispute, the lessee may submit their arguments by email to the customer service and claims department within 14 days.  If it is not possible to reach an agreement over the resolution, the lessee may present their claim to the relevant court or consumer authority.

  • Basic roadside assistance

  • The Roadside Assistance service included in the basic cover provides a 24-hour roadside assistance service.

    This service, which includes towing, recovery and roadside repair, will always incur a cost.

    Please note that, if the customer requests assistance but then decides it is no longer needed, they should call the Record go assistance number to cancel the service. If it is not cancelled, they will need to pay the applicable towing service rates to cover the costs incurred by the provider, according to the distance.

4.3.2. Total Comfort Cover

If the contract holder purchases this coverage, the excess applicable to the basic coverage is eliminated.

For CYAZ, EYAZ, HYAZ, PFAC, LTAR, PQAR, XFAR, PFAH,CKMR, NKMR, DKMR, IKMR, JKMR, SKMR, PKMR and FKMR group bookings, the Total Comfort cover reduces the amount of the excess, but does not eliminate it.

Only drivers who are expressly authorised by Record go in the rental agreement are covered by  the Total Comfort Cover.

The coverage is only valid during the rental period. If the vehicle is returned late, the coverage is rendered void.

Total Comfort Cover includes the following aspects:

  • Coverage of collision damage WITHOUT excess: 

  • If the contract holder follows the procedure established by Record go in the event of an accident, breakdown or mechanical failure (consult section 1. Obligations of the contract holder and authorised drivers in relation to the rented vehicle), he/she will not be responsible for paying any amount.

  • Coverage of damages due to theft WITHOUT excess:

  • If the contract holder follows the procedure established by Record go in the event of a theft or robbery of the rented vehicle (consult section 1. Obligations of the contract holder in relation to the vehicle), he/she will not be responsible for paying any amount.

  • Damage to tyres (including punctures), rims, mirrors, windscreens, locks and battery.

  • Basic roadside assistance

  • The Roadside Assistance service included in the basic cover provides a 24-hour roadside assistance service. This service, which includes towing, taxi service and on-site repairs, will always be charged for. Warning: if the customer has requested the assistance service, but does not need it, he/she must call the Record go assistance telephone number to cancel the service. Otherwise, the towing service fee will be charged according to the distance for the costs incurred by the service provider. Towing service rates:

Coverage exceptions. Total Comfort Cover excludes:

  • Circumstances in which the loss or damage was caused by a breach or violation of the obligations and terms and conditions established in this rental agreement (consult section 1.4).

  • When the loss or damage is caused by raised or hanging objects, barriers and wheel stops positioned at the wrong height, inappropriate transport of objects both inside and outside of the vehicle, natural disasters, catastrophic phenomena, armed conflicts or wars, demonstrations, acts of terrorism, acts of sabotage, strikes or restrictions on free movement; those caused by a modification to the atomic structure of the material, or its thermal or radioactive effects, and others, or the artificial acceleration of atomic particles or for any other case of force majeure that involves the action of any existing official aid agencies.

  • Loss of vehicle documentation.

  • Loss of the vehicle’s number plate.

  • Breakage, or non-violent theft of the keys or leaving the keys inside the vehicle

  • Damage to the undercarriage and roofs

  • Damage to the inside of the vehicle and loading area

  • Damage to the clutch

  • Damage to the engine

  • Special cleaning

  • Wrong fuel

  • Damages to optional extras (GoPad, child car seats, helmets...)
     

  • Damages to further equipment (rear shelf, spare wheel, antenna, warning triangle, top boxes, vest...)

4.3.3. Total Comfort Cover Premium

  • Breakage, or non-violent theft of the keys or leaving the keys inside the vehicle

  • Special cleaning

  • Wrong fuel, providing the vehicle’s engine is not damaged. In such a case, this would not be covered.

  • Premium roadside assistance (cars and vans)

  • The premium roadside assistance included in Total Comfort Cover Premium offers 24-hour roadside service that includes, free of charge, the labour cost of any repair work that can be carried out at the location of the breakdown, a replacement vehicle at the nearest Record go office, subject to availability, the towing service and the rental vehicle for a maximum of 24 hours or a taxi to get to the aforementioned office.

    Exception:

    • Non-compliance with any of the obligations outlined in point 1.4 

    • If the vehicle should run dry for any reason during the hire period, whether it be due to loss, breakage or theft of the charging cable, Record go will bear no responsibility for the cost of roadside assistance, or for any of damage that may result from this situation, as such events are not covered by any of our insurance polices.

    • Should the customer leave the lights turned on and the battery runs out, Record go will not be liable for the cost of any roadside assistance or damage incurred.

    • If the towing service is requested when this is not necessary, or if the garage determines that there has been no breakdown, the cost of said service will be charged.

Coverage exceptions. Total Comfort Cover Premium excludes:

  • Circumstances in which the loss or damage was caused by a breach or violation of the obligations and terms and conditions established in this rental agreement (consult section 1.4).

4.3.4. Roadside Assistance Cover

Roadside Assistance (RSAC) cover provides a 24-hour roadside assistance service which includes, free of charge, the cost of labour for any repairs that can be carried out on the spot at the place of breakdown, vehicle replacement at the nearest Record go office - subject to availability - towing service for towing the vehicle and a hire vehicle for a maximum of 24 hours or taxi to the office.   

Exceptions:

  • Failure to comply with any of the obligations stated in point 1.4.
  • In case the vehicle, for any reason, including cases of loss, breakage, theft or robbery of the cable, runs out of charge during the rental period, Record go is not responsible for the cost of the roadside assistance service nor for the damages due to breakdowns derived from this situation, as this is an event not covered by any of our coverages.
  • In the event that the customer leaves the lights on and runs out of battery, Record go is not responsible for the cost of the roadside assistance service or for the damage caused.
  • In the event that the towing service is requested and it is not necessary or the garage determines that there is no fault, the cost of this service will be charged.

  • Per day 7,95 €
  • Minimum rental 15,90 €
  • Maximum rental 111,30 €

4.3.5. Easy Cover

Only drivers who are expressly authorised by Record go in the rental agreement are covered by  the Easy Cover.

The coverage is only valid during the rental period. If the vehicle is returned late, the coverage is rendered void.

Easy Cover includes the following aspects:

  • Coverage of collision damage and theft WITH excess (CDW and TP)

  • Consult the features of this coverage in section 4.3.1 Basic coverage with excess.

  • Basic roadside assistance

  • This service, which includes towing, recovery and roadside repair, will always incur a cost.

    The Roadside Assistance service included in the Easy cover provides a 24-hour roadside assistance service.

    Please note that, if the customer requests assistance but then decides it is no longer needed, they should call the Record go assistance number to cancel the service. If it is not cancelled, they will need to pay the applicable towing service rates to cover the costs incurred by the provider, according to the distance.

    Towing service fees:

4.4. Penalty Fees

  • Charge for damage, deterioration, loss or theft of the accessories found inside the vehicle, in terms of replacement cost:

    • Vehicle stickers (per sticker): €30

    • Vehicle documentation

    • Tray: official valuation depends on the vehicle model 

    • Top box (only motorbikes): €100

    • Helmet (only motorbikes): €100

    • Spare wheel: official valuation depends on the vehicle model

    • Aerial: €30

    • Emergency triangles: €30

    • Hi vis vest: €20

    • Wheel/puncture repair kit: €100

    • Bungee cord, strap, fastening cable (vans): €30

    • Goods trolley (vans): €150

  • Charge for repairing a tyre puncture: €100

  • Charge for breakage, loss violent or non-violent theft of keys

  • In the event of breakage, loss or theft of the keys of the rented vehicle, Record go will apply a penalty charge of at least € 302,50, plus a penalty for the period of time the vehicle cannot be used, which will be equivalent to at least one rental day in accordance with the daily rate at that time.

  • Charge for damage, loss or theft of the charging cable

  • If the charging cable for electric vehicles gets damaged, lost or stolen, Record go will apply the following penalty according to the specific model:

    • Home charging cable (household plug): up to 1.900 €

    • Charging station cable: 1.000 €

  • Charge for use of the wrong fuel

  • Record go will apply a minimum penalty of €302.50 and a maximum of up to the value of the total excess for the vehicle depending on whether or not the engine has broken down (official valuation).

  • Penalty for vehicle substitution

  • In cases of negligence, cases excluded from the coverage purchased, and if the obligations indicated in point 1.4 are breached: €100

  • Charge for special cleaning

  • The rental price includes standard cleaning of the rented vehicle. However, if the rented vehicle requires special cleaning, Record go will charge the contract holder €75 or €150 to cover the costs of processing, special cleaning, and suspension of the vehicle.

    Special cleaning constitutes any cleaning that requires more exhaustive action and involves taking the vehicle out of its standard cleaning routine. 

    The following table provides some examples of how the special cleaning charges are applied:

An employee will check the vehicle with the lessee upon return and their claims will be taken into account. They will be sent a report and details of the costs as well as photos and evidence of the vehicle’s uncleanliness. In case of dispute, the lessee may submit their arguments by email to the customer service and claims department within 14 days. If it is not possible to reach an agreement over the resolution, the lessee may present their claim to the relevant court or consumer authority.

  • Charge for smoking inside the vehicle

  • Record Go does not permit smoking inside their vehicles. If the vehicle smells of tobacco smoke, Record go will apply a penalty fee of €50 to cover the costs of processing, special cleaning, and suspension of the vehicle.

    An employee will check the vehicle with the lessee upon return and their claims will be taken into account.. In case of disagreement with the assessment carried out, the lessee may submit their claims to the customer service e-mail address within 14 days and, in case of disagreement with the resolution, go to consumer arbitration, whose decision the parties submit to for the resolution of such conflicts. 

  • Charge for driving outside of the territory authorised by Record go

  • If the ‘Crossing borders’ extra is not purchased and the vehicle is driven outside of the territory authorised by Record go (Peninsular Spain for mainland rentals or the island on which the vehicle was collected for the Balearic Islands), Record go will apply a €400 penalty. Regardless of whether or not the ‘Crossing borders’ extra has been taken out, if the vehicle travels beyond the territories authorised under this extra (see point 4.2.4), a penalty of €1,000 will be charged plus €0,25 for each kilometre travelled from the start of the rental in addition to the corresponding cancellation of coverages and the consequences specified in point 1.4 of "Obligations of the contract holder in relation to the vehicle". This consists of the coverage being nullified and the contract holder becoming responsible for rental vehicle damages, towing fees, repatriation and any and all costs occasioned, up to the full value of the deduction.

  • Charge for one-way rentals

  • Record go does not offer one-way rentals. The contract holder must return the rented vehicle to the same office as the pickup.  If the contract holder returns the rented vehicle to a office that is different to the pickup, Record go will apply a penalty fee of 200 €. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section '4) Extras, accessories, charges and coverages’, Charge for returning the vehicle late), the repatriation of the vehicle and the vehicle recovery cost.

  • Charge for returning the vehicle late

  • Record go offers a 60 -minute grace period for returning the rented vehicle in relation to its pickup time.

    However, for it to be applicable, this grace period should be determined and applied at the time the contract is signed, when the return time is chosen, otherwise it cannot be applied.

    Record go's rental fees are calculated based on 24-hour periods from the start of the rental period. 

    In the event that the contract holder does not return the rented vehicle to the agreed drop-off point at the time specified in the rental contract, the contractual coverage will be invalidated and the contract holder will be liable to pay for the damage caused to the rented vehicle and for all expenses incurred, up to the amount of the total excess and Record go will apply a penalty of €40 plus expenses incurred in recovering the vehicle, which will be a minimum of €436 in the event that it has been reported after 24 hours have passed.

    In addition to the above, the contract holder will also be responsible for paying the current daily rental rate (1) at that time, including charges for the options contracted for every day of delay in the vehicle return.

    In the same way, if Record go takes more than 60 minutes from signing the rental agreement to delivering the vehicle, the client will be compensated the same quantity of 40 €.

    This penalty will also be applied to the Meet&Greet extra under the terms indicated in 4.2.3.

  • Charge for abandoning the rented vehicle

  • If the vehicle is abandoned, Record go will apply a penalty fee of 200 €. In addition to this fee, the contract holder will also be responsible for paying the daily rental fee (consult the table of fees in section '4) Extras, accessories, charges and coverages’) and the vehicle recovery cost.

    This penalty will also be applied to the Meet&Greet extra under the terms indicated in 4.2.3. 

  • Charge for returning the rented vehicle to a public car park at the pickup airport

  • In the event that the contract holder returns the rental vehicle in a public car park at the pick-up airport, and if it is given back on the same day, Record go will apply a penalty of €30.00, as stated in the contract. If the rented vehicle is not recovered on the same day as the return date established in the rental agreement, Record go will apply the corresponding penalty fee for the late return of the vehicle, and the customer will be responsible for paying the vehicle recovery cost.

  • Charge for parking the rented vehicle in Record go parking spaces during the rental period

  • If the driver parks in Record Go parking spaces during the rental period, Record go will apply a penalty fee of €25/day.

  • Administration fee for the accident management, damage management and advice service (DAF).

  • In case of damage, the driver must fill in the accident report, submit it to the Record go office upon returning the rented vehicle and send a copy of the report to the e-mail address [email protected].

    Record go will process the accident reports, notify the driver of the appropriate action to take, and offer advice if they suffer any injuries and/or receive a court summons. Record go will charge the contract holder €50 for this accident management, damage control, and advice service (DAF). 

    If the contract holder has purchased the Total Comfort Cover or Total Comfort Premium, Record go will not charge any fee for this service.

  • Charge per additional kilometre in rates with limited kilometrage (Go Easy Vans and Just Go Vans)

  • Should the kilometrage included in the rental be exceeded, Record Go will apply a penalty of €0.26 for the CKMR group,  €0.28 for the NKMR group, €0.30 for the DKMR group, €0.32 for the IKMR y JKMR groups, and €0.36 for the SKMR, PKMR  and FKMR group per each additional kilometre. If the vehicle is returned early, the applicable kilometres per day for the number of days used will be calculated and said penalty charged if appropriate.    

The above penalties are detailed and communicated to the customer during the booking process, highlighting the key information, so that the information can be selected for acceptance.  

Upon return of the vehicle, an employee will check the vehicle with the lessee and their claims will be taken into account. The customer will be informed of any penalties applicable as indicated above.  They will be sent a report and details of the costs, photos and the necessary supporting documentation. In case of dispute, the lessee may submit their arguments by email to the customer service and claims department within 14 days. If it is not possible to reach an agreement over the resolution, the lessee may present their claim to the relevant court or consumer authority.

Charge per additional kilometre in rates with limited kilometrage (Go Easy and Just Go, Madrid and Barcelona, vehicles with limited mileage)

Should the kilometrage included in the rental be exceeded, Record go will apply a penalty of €0.35 per each additional kilometre. If the vehicle is returned early, the applicable kilometres per day for the number of days used will be calculated and said penalty charged if appropriate.


 

5. Fuel

6. Payment

By signing the rental agreement and the vehicle pick-up, the lessee commits to pay without the right of withdrawal.

By signing the rental agreement, the contract holder expressly authorises Record go to use the bank card provided at the time of making the booking for the following purposes:

  • Charge the rental of the vehicle with all the selected options: extras, additional coverage, and fuel tank (Consult table)

  • Where applicable, to block the pre-authorization amount corresponding to the group of the rented vehicle. This amount will not be available for use until it is unblocked.

  • For the rental of two- and three-wheeled vehicles (motorbikes) and vans, a preauthorisation will be held. 

    In bookings of special groups and in payments made with debit cards, the pre-authorization amount will be charged and not blocked.

    Depending on the card issuer banking entity, the pre-authorization amount can take up to a maximum of 30 calendar days after the date of completion of the rental contract to appear in the banking card statement of the holder of the contract.

    Record go is not responsible for any commissions charged by the bank of the contract holder for returning the pre-authorization amount.

  • Where applicable, to charge for any expense resulting from alterations caused to the vehicle during the rental period (damages, documentation, missing accessories, state of cleanliness) and for the breach or violation of any of the obligations and/or terms and conditions established in this rental agreement.

  • Make a possible pre-authorisation of up to €1,000 for groups PFAC, PFAH, IVMR, JVAR, FVMR, FVAR, SVMR, SVAR and PVAR.

6.1. Payment methods

6.1.1. Types of cards accepted 

  • Visa and MasterCard credit cards

  • Visa and MasterCard debit cards (except prepaid cards)

  • American Express cards (on the condition that the contract holder purchases our Total Comfort Cover).

  • EC-Karte and UnionPay cards (except prepaid cards)

Exceptions:

  • PFAH, PFAC, LTAR, PDAH, PFAR, XFAR and PQAR bookings: payment by credit card only.

6.1.2. Restrictions and considerations related to payment

  • Pre-payment cards (any kind) are not accepted.

  • Payment is not accepted by smartphone, smartwatch or any other similar device, neither do we accept payment by cheque or bank transfer.

  • The holder of the bank card used to pay for the rental must be the contract holder and must be present at the time of making the payment.

  • Only one bank card can be used per contract and the card must be non-transferable. For Premium Car Class (see point 9 vehicle group) payment will only be accepted by credit card.

  • If the contract holder is not the primary driver, Total Comfort Coverage must be purchased and, in addition, the ‘non-driver contract holder’ fee will be charged for two-wheeled vehicles.

    • One customer can hold multiple contracts so long as they take out the Total Comfort Cover or Total Comfort Premium Cover, but under no circumstances may they be the main driver in more than one vehicle contract of the same type.

  • The payer is responsible for knowing the PIN number of their bank card if they are paying with a card that includes this technology.

  • The payer must ensure that the bank card has sufficient funds at the time of picking up the vehicle to pay for the rental with all the selected options, and, where applicable, to block the pre-authorization amount corresponding to the group of the rented vehicle.

  • Credit and debit cards with no numbers must be in the name of the holder and the numbers and expiry date for the card must be provided when the contract is signed.

6.2. Payments and blocking at the time of pickup

At the time of picking up the vehicle and paying for the rental, Record go will charge the contract holder's bank card the rental price to be paid at the desk and will block the pre-authorization amount corresponding to the type of rented vehicle.

The pre-authorisation amount will not be available for use until it is unblocked. Record go will not be held responsible for any commissions charged by the lessee’s bank for refunding the pre-authorisation.

The pre-authorization amount is the price of the excess that is blocked on the contract holder's bank card when picking up the rental if Total Comfort coverage has not been purchased.

    *If the contract holder has chosen prepayment as the payment method, the prepaid amount is not included in the rental charges to be paid at the desk. If the contract holder has selected a non-prepaid fee (pay at pickup), Record Go charges the rental fee when the vehicle is picked up.

6.3. Foreign currency payment service (DCC)

Using DCC, we give you the option of making payments in any currency through an automatic currency exchange. This service is available both on our website (www.recordrentacar.com) and in our branches. 

DCC is a financial service offered by our banking entity that immediately notifies you of the amount in the corresponding currency, applying the current exchange rate plus a very competitive conversion fee, and substitutes the currency conversion usually carried out by the company that manages your credit card.

If a client requests the foreign currency payment service (DCC), the rental charges will be displayed in euros in the "Payment" section of the rental agreement, together with exchange rate information for the selected currency and the conversion fee.

6.4. Cash payment

Only exceptionally will cash payments be accepted, and at the time of collecting the vehicle it will be necessary to:

  • Leave a cash deposit, which will be reimbursed upon the vehicle’s return, unless there is a breach of contract or additional obligations are created according to the general terms and conditions of the contract. The amount of the deposit will be that which is specified below according to the type of vehicle.

  • Make a photocopy of the lessee’s ID card, passport, valid driving licence and a Gold credit card (visa or Mastercard), who authorises the company to keep this documentation for the purposes of complying with the obligations arising from the contract and to put on such card any charges resulting from the fulfilment or breach of contractual obligations.

Cash payment is not available for booking groups not mentioned in the table above.

11.1. Data protection

Record Go Alquiler Vacacional S.A. (hereinafter RECORD GO) is responsible for processing the following data: A) those of the Client if he/she is self-employed or independent b) those of natural persons who by providing services to the Client come into contact with RECORD GO to enable the continuance, development and management of the business relationship formalised through the rental agreement (contact persons), and to whom the Client undertakes to apply the full content of this section. 

The personal data of the interested parties mentioned above will be processed for the following purposes:

  1. To enable the maintenance, development and management of the business relationship formalised by this document. The data processed for this purpose shall be kept for as long as the business relationship is maintained and, once it has ended, for the legally stipulated conservation periods and prescription of responsibilities. The legal basis for processing is: a) In relation to the self-employed or freelancer Customer themselves, the execution of a contract to which the interested subject is a party; b) In relation to the contact persons, the legitimate interest of RECORD GO in contacting the Customer through them.

  2. Keep the client informed of products, services and RECORD GO news (electronically or otherwise), which includes creating profiles. The data processed for this purpose will be kept until the revocation of the consent given for the receipt of such communications and, thereafter, for the legally stipulated conservation periods and prescription of responsibilities. The legal basis for processing is consent. If you do not consent to the processing of your data for this purpose, please do not tick the box on the front of the contract. The related advertising exclusion systems are available to the interested parties on the www.aepd.es website.

  3. In accordance with the terms of article 6.1.f) of the GDPR, which establishes that the data controller satisfying their legitimate interests is a legal basis for data processing. RECORD GO would like to inform you that rental vehicles may be tracked by geolocalisation at any time, to ensure: a) that the vehicle has not been stolen, and, b) that the rental vehicle does not leave the mainland or national territory without authorisation.

Record go will not disclose data to third parties. However, it may communicate data to the following third parties in the following cases: 

1- Public Authorities for compliance with legal obligations (e.g., traffic fines). The renter knows, is aware and accepts that, in the event of a fine, RGO may disclose their personal data to associated companies or unassociated companies (owners of the vehicle) so that they may identify the renter before the competent authorities. Said communication of data is within the scope of Art. 11.1 a) of Royal Legislative Decree 6/2015, of 30 October, approving the consolidated text regarding the Law on Traffic, Circulation of Motor Vehicles and Road Safety.

2- Banking entities for managing charges, payments and attempts to reverse payment (in which case we can provide the geolocation data required to prove the client’s breach of contract conditions).

3- Data may also be communicated to the following categories of data processors: Providers of electronic communications, office IT, hosting, IT maintenance, administrative agency, accounting, auditing, consultancy, legal representation and insurance companies. Some of these processors may be located outside of the European Economic Area, in which case Record Go will have previously adopted the necessary guarantees in terms of data protection.

Interested parties may exercise their rights to access, rectification, deletion, limitation of processing, data portability and objection (including making profiles), as well as withdraw their consent at any time without affecting the lawfulness of the processing prior to their withdrawal, by sending their request to Avda. Casalduch nº 61. Castellón C.P.:12005; or to [email protected], attaching, in each case, a photocopy of their national ID card, their passport or equivalent document, in force. In any case, interested parties have the right to file a claim with the relevant supervisory authority if they deem it appropriate.

11.2. Legal system and code

The rental agreement is governed by the terms and conditions described in the previous points and by Spanish legislation on the subject of leasing. In the event of any divergence arising between the Lessor and the Lessee, they agree to submit to the Spanish Courts that legally correspond with express will against submission to arbitration.

11.3. Conduct code

Our company is part of the National Federation of Car Rental Companies without Drivers (FENEVAL) and all our practices are carried out in accordance with the codes of this Association and the provisions of the legislation in force. 

11.4. Reservation of rights

Record go reserves the right to refuse the rental of vehicles to customers that violate any of the conditions or obligations established in the present document.

Record go also reserves the right not to rent the vehicle in the event of reasonable doubt about the possibility of non-compliance with the obligations of this contract, due to a customer’s history of non-payment or incidents.
